SECTION 375 OF INDIAN PENAL CODE
The Indian Constitution’s Article 21 states that rape violates the victim’s fundamental rights. It is the most morally and physically abhorrent crime in society because it violates the victim’s right to privacy and to a private body and mind. A murderer destroys the victim’s body, but a rapist destroys and defiles a defenceless girl’s spirit. The experience of rape uproots the victim’s entire existence. A rape victim cannot in any way be viewed as a collaborator.
Since rape leaves a lasting mark on the victim’s life, they are regarded with more respect than injured witnesses. A crime against society that violates the human rights of the victim is rape.
Section 375 of indian penal code
According tosection 375 of indian penal code, rape is defined as having sex with a woman against her will, without her agreement, by force, deception, or fraud; it can also occur while she is under the influence of drugs or alcohol, mentally unstable, or both; in any event, if she is less than 18 years old.
If any of the following apply, it’s rape:
- In opposition to her wishes.
- Without her permission.
- With her consent, provided that it was acquired by making her or anybody else she is interested in fearing harm or death.
- With her consent, provided that the man is aware that she does not consider him to be her spouse and that her agreement is based on her belief that he is another man with whom she is or was lawfully married.
- With her consent, if she is unable to comprehend the nature and implications of what she is consenting to at the time due to intoxication, mental instability, or the giving by him or another person of any stupefying or unwholesome material.
- When she is less than sixteen, with or without her permission. Justification: Penetration is enough to qualify as the sexual contact required for the commission of the rape offense.
Consent under section 375 of ipc
As per section 375 of ipc, consent is defined as a clear and voluntary agreement expressed by a woman through verbal or nonverbal communication indicating her willingness to perform a certain conduct. Consent is essentially about choice, not will. In order to understand consent, two things must be proven:
- That the subject has the capacity to grant consent and.
- That the subject has freely chosen to accept the act.
Types of Consent under section 375 of ipc
The types of consent under section 375 of indian penal code are as follows:
- Implied Consent: This kind of consent is expressed by an individual by their actions. Signs and other non-verbal cues can be used to express consent. The legal dictionary defines implied consent as consent that is assumed based on facts, gestures, or silence as well as by inactivity or inaction. For instance, A is a fireworks retailer. B indicates that he wishes to make purchases from him as he walks inside his store.
- Express Consent:This kind of consent can be expressed verbally or in writing by the individual. It is simpler to prove in a court of law if there is express consent. For instance, if B replies yes when A asks him to buy a piece of property, that is express consent.

- The punishment for rape (section 375 ipc punishment) is mentioned in Section 376 of the Indian Penal Code which outlines the punishment for the crime of rape.
- Rape offenders face a harsh 10-year jail sentence, which can be extended to life in prison based on the seriousness of the offense. Fines may also be imposed.

- In the case of Himachal Pradesh vMango Ram, Jagia Ram, the eldest daughter, was Prosecutrix. The prosecutrix was joined by the 17-year-old accused. When the accused caught her off guard, she was made to lie on the cowshed and engage in sexual activity. The girl attempted to resist the accused’s advances, but the accused overcame her, and the act was carried out against the victim’s will. As a result, the accused was found guilty of the rape offense, according to the Supreme Court.
- In the case ofTulsidas Kanolkar v State of Goa, the girl was not in a suitable state of mind to consent to sexual activity. The defence of lawful consent was asserted by the accused. The extra session judge who found the accused guilty of the crime imposed a 10,000 fine in addition to a strict one-year jail sentence. The sentence was lowered to seven years by the High Court. The Supreme Court rejected the appeal, finding that there was no consent, just simple acceptance.
section 375 of ipc: Important Amendments
- Following the 2013 Criminal Law (Amendment), Section 375 was expanded. Prior to now, the section’s scope was restricted.
- The amendment further stated that it would be considered rape if a male were to place an item or any other bodily part into a woman’s mouth, urethra, anus, or vagina.
- The statute broadened the definition of rape to include activities such as applying mouth or touching private regions, or forcing someone else to do so, or penetrating the woman’s penis or any other part of her body to any extent.
- It has been explained that the word “penetration” refers to any degree of penetration.
- The amendment further said that the absence of physical resistance is irrelevant and that the court will assume that consent was not given during sexual relations if the victim asserts this after considering the case’s facts.
A sexual offense against a woman is called rape. Rape occurs when a woman is forced to have sex with a man against her will. The individual might be her parent, her instructor, or anybody else. It was discovered that the father frequently coerced the daughter into engaging in sexual activity.
